The Arbitration Fairness Act seems like one of those bills destined to be discussed but I can't imagine that it will go anywhere in the first 6 months. There is just too much on Congress' plate and it could be controversial. While the Dems may want to pick some fights, there doesn't seem to be a big constituency (perhaps other than trial lawyers) who will really push this through.

Thanks for dropping by to comment Dan. My arbitration training today made me re-re-consider my many decisions to resist arbitration during a 25-year litigation career.

My arbitrator friends (some of whom I've joined on arbitration panels) are the most impressive hearing officers of any I've been privileged to litigate and try cases before.

Still, I understand attorney fears of no appeal -- which STILL would deter me. Otherwise, I'm becoming a big arbitration fan.
