         <description><![CDATA[<p>Vickie:</p>

<p>I find it interesting and somewhat amusing that a consent judgment, or stipulated judgment as you call it, seems a novel approach to settling such a large case when it is such a common tool in my local small claims court.  We even a have triplicate form at the ready! </p>

<p>I find it a most useful tool when the parties seem ready to agree and then the defendant throws the gasoline of "I need payment terms" on the smoldering ember of what was a fire.  </p>

<p>It really does satisfy the needs of both parties.  The defendant gets the benefit of agreeable payment terms and does not have a judgment against them in the court docket, while the plaintiff gets the security of knowing they can execute a judgment the moment the defendant fails to meet the terms of the agreement. </p>

<p>Good to see that the skills and tools I use to settle $5000 cases help get $5 million cases settled!</p>

         <description><![CDATA[<p>The entry of a stipulated judgment IS relatively novel in large commercial cases because the parties are usually well-heeled. But I don't mean to imply that using the Stipulated Judgment in this case was a particularly brilliant suggestion on my part.  Of course the attorneys are aware of it.  I mean only to recount the course of the mediation as an instance where writing up the entire agreement (not merely deal points) was absolutely critical.  There's more on this to come.  Thanks for dropping by.</p>
